By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
Please read these Terms carefully before using our Service. Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms.
Standard packages shown on the Website are one-time services, not subscriptions, and do not automatically renew. They provide the assessment or planning deliverables described on the pricing page. Custom software development is not included unless expressly stated.
Before work begins, we may request information reasonably necessary to understand the selected use case. Delivery time begins after we receive the required information and confirm the engagement in writing.
Each standard package includes one written clarification request submitted within seven calendar days after delivery. New use cases, additional workflows, substantial revisions, software development, and implementation are outside the standard package scope. Business days are Monday through Friday, excluding United States federal holidays.
Custom development, integration, or implementation work requires a separate written scope, timeline, price, and any applicable ownership or licensing terms.
Production deployment, ongoing monitoring, model retraining, maintenance, service levels, and security operations are included only when expressly stated in that separate written scope.
The Website and its original content, features, and functionality remain the property of Evortrix Inc and its licensors.
Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of EVORTRIX.
You retain ownership of materials you provide. You authorize us to use those materials only as reasonably necessary to respond to your inquiry or provide the agreed service.
AI-related recommendations and outputs may be incomplete or inaccurate and should be reviewed by qualified people before being used for operational, legal, financial, medical, safety, or other important decisions.
Customer materials are not used to train general-purpose AI models unless the customer provides separate written authorization. Additional data-handling terms may apply to custom engagements.
Prices displayed for standard packages are stated in U.S. dollars and are charged once. They are not recurring subscription fees. When online payment becomes available, payment may be processed by a third-party payment provider under its own terms and privacy notice.
A customer may request a full refund before work begins. Work begins when we confirm that the required information has been received and notify the customer that the engagement has started.
After work begins, standard-package fees are non-refundable because the services involve time-based analysis and preparation. If we cancel an engagement or cannot provide the purchased deliverable, we will issue a full refund. If a delivered item materially omits an included element of the purchased package, the customer must notify us within seven calendar days and we will correct the omission without an additional fee. These conditions do not limit rights that cannot be limited under applicable law.
You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:
We may restrict access to the Website or decline a service request when necessary to address unlawful activity, security risks, abuse, or a material breach of these Terms.
In no event shall EVORTRIX, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
Our total liability for any claims under these Terms shall not exceed the amount you paid us to use the applicable Service(s) in the 12 months preceding the claim.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. EVORTRIX makes no representations or warranties of any kind, express or implied, as to the operation of their services, or the information, content or materials included therein.
You expressly agree that your use of the Service, including AI-generated outputs, is at your sole risk. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.
These Terms shall be governed and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.
Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Wyoming.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will post revised Terms on this page and update the "Last updated" date. Unless a later date is stated, revised Terms take effect when posted and apply prospectively.
By continuing to access or use our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, please stop using the Service.
